1. WARNING:
THE SERVICE PROVIDED BY MySafeWorkplace® IS NOT AN EMERGENCY HOTLINE OR SUBSTITUTE
FOR CALLING 911, OR TAKING OTHER PRECAUTIONS TO SAFEGUARD ONE'S SAFETY, PERSONAL
WELL-BEING OR PROPERTY. IN THE EVENT OF AN EMERGENCY OR OTHER SITUATION IN WHICH
THE REPORTING PARTY FEELS THERE IS OR COULD BE A THREAT TO THEIR SAFETY, PERSONAL
WELL-BEING, OR TO PROPERTY, THE REPORTING PARTY ACKNOWLEDGES THAT HE OR SHE IS TO
IMMEDIATELY CALL 911 OR TAKE OTHER APPROPRIATE MEASURES TO PROTECT THEMSELVES, THOSE
AROUND THEM OR ANY PROPERTY WHICH MAY BE IN DANGER OF HARM.
2. REPORTING PARTY PRIVACY AND ANONYMITY
MySafeWorkplace®, pursuant to an agreement between it and the Reporting Party, has
instituted a procedure whereby Reporting Parties may report certain incidents concerning
his or her employment to MySafeWorkplace® and may do so in an anonymous fashion.
Should you submit an incident report via telephone or Internet from within your
organization or through equipment provided by your organization, MySafeWorkplace®
does not take any responsibility for possible monitoring and/or tracking of information
submitted. The types of incidents which may be reported include those which relate
to threats of violence, harassment, discrimination, theft and other concerns about
the Reporting Party's working environment. MySafeWorkplace® will receive this information
and will prepare a report for the Reporting Party's employer. The obligation of
MySafeWorkplace® extends only to receiving and reporting information and the Reporting
Party acknowledges and agrees that MySafeWorkplace® will take no action to address
the subject matter of any information reported through this system, without further
authorization and direction from the Reporting Party's employer, which may or may
not be given by the Reporting Party's employer. MySafeWorkplace® respects the Reporting
Party's right to privacy and any information that personally identifies the Reporting
Party. MySafeWorkplace® will not knowingly disclose the Reporting Party's contact
information (name, phone number, fax number or email) to anyone unless the Reporting
Party specifically authorizes disclosure of that information through the MySafeWorkplace®
Web site. MySafeWorkplace® may use any contact information which the Reporting Party
supplies in order to ask the Reporting Party follow up questions on behalf of the
organization to whom an incident report may be submitted, and will maintain the
Reporting Party's anonymity in that process, unless the Reporting Party authorizes
MySafeWorkplace® to release such information. MySafeWorkplace® will not knowingly
release nor sell the Reporting Party's contact information to any 3rd
parties without the Reporting Party's prior permission.
3. NOTICE AND DISCLAIMER
The employer providing this service to the Reporting Party reserves the right to
choose how it will act, or not act, based upon the information provided to MySafeWorkplace®
or in a report from MySafeWorkplace® to the employer, unless otherwise required by
law. Furthermore, the employer is not required to disclose its response or actions
pursuant to any information that may be provided or reported to it.
4. RELEASE
As a User of the MySafeWorkplace® service, and by submitting a report to MySafeWorkplace®,
the Reporting Party acknowledges that the sole obligation of MySafeWorkplace® shall
be to receive and transmit information provided by Reporting Party in the incident
report on an anonymous basis, unless otherwise specified by the Reporting Party,
to the Reporting Party's employer or the organization to which the incident report
pertains. The Reporting Party, on behalf of himself or herself, his or her heirs,
successors, family members, agents and assigns, agrees to and does hereby release
MySafeWorkplace® and its respective officers, directors, shareholders, employees,
successors, predecessors, agents and assigns (the "MSW Parties"), of and from, any
and all liability, claims, actions, causes of actions and damages which relate in
any way to the MSW Parties' or the Reporting Party employer's actions or failures
to take action as the result of having received, or been available to receive, information
relative to an incident report.
5. ACKNOWLEDGEMENT
THE REPORTING PARTY FURTHER ACKNOWLEDGES THAT THE INTENTIONAL MISREPORTING OF INFORMATION
OR USE OF THIS SERVICE FOR ANY PURPOSE OTHER THAN THAT FOR WHICH IT IS INTENDED
IS PROHIBITED, AND THAT THE INTENTIONAL MISUSE OF THIS SERVICE MAY RESULT IN INVESTIGATION,
AND POSSIBLE CRIMINAL PROSECUTION AND/OR CIVIL LIABILITY FOR MONETARY OR OTHER DAMAGES.
